FAMILY LAW, CHILD SUPPORT

In order to provide safety and protection to a child, Family law has proposed a law for Child support, according to which a parent is held responsible for providing a certain and designated amount for his child, to the other parent, caregiver or guardian for the rest of his entire life, so that all the expenses including food, shelter, education and other expenditures of his child can be fulfilled smoothly and properly without any hindrance.

The family law, for child support, is mostly obligated when the relationship between two individuals is broken, like divorce, or never even existed, like in case of pre-marriage pregnancy. In such cases, it is the obligatory responsibility of the parent, who is not being provided with the custody of the child, to provide and fulfill all the basic requirements and necessities to his child even after getting divorced or separated completely from his partner.

In official terms, it can be stated as obligor is responsible for providing the financial support to the oblige, so that she may fulfill her child’s basic needs. In most of the cases, child support or child maintenance is the responsibility of both parents. Even if the couple gets divorced or separated, the non-custodial parent, even if she is the mother, is responsible to provide the authorized amount for child maintenance to the non-custodial parent, even if he is the father.

Moreover, the fewer number of these cases have been reported in which both the parents are custodial parents, and it is based on the child's own will, to live with any of his parents or move from one to another. In such cases, both the custodial parents need to fulfill their child's responsibility and requirements, during the months or years when the child has been living with them.

Thus the rights of a child, according to which parents are kept responsible for upbringing their child in the best possible manner by providing them all the basic and advanced facilities for their child is considered as one of the most essential essences of life, as it is the basic right of a child that his parents must take his full responsibility, particularly when they have become the reason for bringing the children into this world. In order to legislate and include this policy, United Nations Convention on the rights of the child has coerced and forced to provide equal rights to the children whose parents have been separated or divorced, with all the necessities of life and protection of their future. Brisbane Family Lawyers provides safety and protection to a child support & Family law.
